General terms and conditions of the French Leather Marketplace

The French Leather Marketplace is a service offered by the Fédération Française de la Tannerie Mégisserie (the French Federation of Tanners, hereinafter “the FFTM”) which allows tanners who are members of the FFTM (hereinafter the “Tanner” or “Tanners”) to connect with Professionals producers of finished leather products or finished products with leather wishing to obtain, free of charge, leather samples (hereinafter the “Professional” or “Professionals”).

The Fédération Française de la Tannerie Mégisserie is an association declared in accordance with French law, registration number 784 359 150, with registered offices at 122 rue de Provence, 75008 Paris, France.

Purpose

These general terms and conditions (hereinafter “the T&Cs”) define the conditions under which the French Leather Marketplace operates, and by which free samples of leather are offered by the Tanners to Professionals.

The role of the FFTM is solely to provide the French Leather Marketplace and not to act as intermediary between the Tanner and the Professional.

Requesting access to the French Leather Marketplace

To access to the French Leather Marketplace, it is necessary to open an account with the FFTM.

It is free to open an account.

Accounts are available only for Professionals.

Your request to open an account is subject to approval by the FFTM, which reserves the right to refuse the request without having to justify its decision.

Once the FFTM receives a request to open an account it has a period of 10 days in which to approve or refuse the request.

Presentation of samples

Samples are a small cutting sample of the leather concerned.

A description of each leather for which samples are available upon request can be found on the French Leather Marketplace.

Nevertheless, the images, colours, textures and finishes available and, more generally, the description of the leathers for which samples offered on the French Leather Marketplace are not legally binding.

Samples are free.

Only single samples can be requested.

Availability of samples

Tanners will make every possible effort to ensure the availability of the samples they offer via the French Leather Marketplace.

Nevertheless, the FFTM and the Tanners cannot guarantee that the samples offered on the French Leather Marketplace are available upon request. The message confirming receipt of your request does not constitute confirmation of the availability of the samples requested.

The Professional will be informed as soon as possible in the event that any of the samples requested are not available.

Under no circumstances shall the unavailability of one or several samples constitute grounds for compensation.

How to request samples

Once the Professional’s account has been approved, they can request samples via an order process through the French Leather Marketplace:

  • The Professional adds the sample they wish to receive to their shopping cart by clicking on “Add to cart”.
  • Once they have selected their samples, the Professional clicks on “View my Cart” to see a list of the various samples.
  • The shopping cart lists the samples by Tanner for a request to be sent to each one.
  • The Professional can remove samples from their cart by clicking on the “Delete” button.
  • To confirm the request, the Professional clicks on the “Checkout” button.
  • The Professional is then directed to a page giving an overview of the request, on which they enter the delivery address for the samples.
  • To finalise the request, click on “Complete checkout”.

A message confirming the request will be automatically sent by email.

Any request deemed to be irregular, in particular with regard to the number of samples ordered, or recurring requests for the same sample by a single Professional or to the same address or passed by a person who would not meet the definition of Professional within the meaning of these general conditions may be refused and the Professional informed of the decision.

Delivery of samples

The delivery fees bby French post will be met by the Tanner sending the sample(s). The costs relating to other shipping methods that would be requested by the Professional or required taking into account the country of delivery of the samples, will, after validation by the Professional, be at his expense or shared between the Tanner and the Professional.

Delivery is generally made within a period of 4 weeks. However, this delivery time is for information purposes only, and under no circumstances shall a delay in delivery constitute grounds for compensation.

Use of samples

The samples provided are only intended for the evaluation by the Professional requesting them of the qualities of the leather they represent.

They are sent exclusively to, and for the sole use of the Professional.

They are not intended for resale or, more generally, any other use.

Liability

The FFTM is only an intermediary between the Tanners and Professionals requesting samples. As such, its liability cannot be sought in the event of an order, in particular a dispute relating to the availability or conformity of the samples and their delivery.

The FFTM only accepts responsibility for direct damages caused by events that are directly attributable to its role as a technical partner, excluding all other damages (loss of business, etc.)

Protection of personal data

The FFTM processes personal data for the contact details of the natural person of the Professional (hereinafter “the Person concerned”) for the purposes of:

  • Opening and managing their account,
  • Processing requests for samples,
  • The sending of information, newsletters and marketing information, etc. by the FFTM or the Tanners to which the Professional has made a request for samples, unless the Professional should refuse this.

Essential personal data are identified as such in the webforms. If the Professional fails to provide this information, the FFTM and, as the case may be, the Tanners to which the sample requests were made will be unable to satisfy the request.

The processing of these data are based on the performance of a contract to which the Person concerned is party and, as appropriate, in the legitimate interests of FFTM and/or the Tanners to inform them and undertake marketing actions to them.

The data are stored for the period during which the Professional’s account is active, then archived for legal purposes during the mandatory period for these purposes, and for marketing actions for a period of three years from their collection or from the last contact.

These data are shared only with authorised personnel for the departments concerned within FFTM, as well as certain suppliers who may have reason to access them.

The essential data for processing requests for samples are transferred to those Tanners from whom samples have been requested. As necessary, the Tanners are informed that the Person concerned has refused the use of their data for marketing purposes.

The FFTM ensures that data are processed in such a way as to guarantee an appropriate level of data security.

The Person concerned has a right to access, correct, and delete, and to the portability of their data, as well as a right to oppose or limit their processing under the conditions and limits provided by regulations. They also have a right to specify conditions relating to the storage, deletion and transfer of their personal data after their death.

To exercise their rights, the Person concerned should contact the FFTM by email at the following address: DPOatleatherfrance [dot] com or by regular mail, addressed to the Délégué à la Protection des données (Data Protection Officer), Fédération Française de la Tannerie Mégisserie, 122 rue de Provence, 75008 Paris, France. The request should indicate their family name, first name, postal address and specific nature of the request. In case of reasonable doubt as to the identity of the person making the request, the FFTM may ask them to provide additional information necessary to confirm the identity of the Person concerned.

If the person concerned believes that their rights have been infringed, or that the processing of data by FFTM does not comply with the applicable regulations, they can make a complaint to the French national data commissioner’s office, the Commission Nationale de l’Informatique et des Libertés (CNIL), 3 place de Fontenoy, TSA 80715 75334 Paris Cedex 07, Tel. +33 1 53 73 22 22.

Cancellation of the service, and deleting an account

The Professional can delete their account at any time, which results in the immediate withdrawal of access to the French Leather Marketplace service.

The FFTM reserves the right, at any time and without providing justification for, or prior notification of its decision, to withhold access to the French Leather Marketplace.

Applicable law, competent court

The law applicable to these General Conditions is French law.
In the event of a dispute, the Parties shall assign jurisdiction to the competent Tribunal within the jurisdiction of where the Federation FFTM is located.

Amendments to the T&Cs

The T&Cs may be the subject of amendments at any time at the initiative of the FFTM.

In case of amendment of the T&Cs, a new version will be automatically applicable after a period of one (1) month following the notification sent to the Professional by the FFTM using any medium.

During the said one-month period, the Professional is free to delete their account. If the Professional should fail to delete their account within this period, the new T&Cs applicable to the continued use of, and access to the French Leather Marketplace shall be deemed to have been accepted.
